These Terms of Use ("Terms") govern your access to and use of the websites, patient portal, telehealth links, electronic forms, secure messaging tools, online scheduling tools, educational materials, and other digital services made available by CaroMas Healthcare Services, LLC ("CaroMas), collectively referred to as the "Services."
Please read these Terms carefully. By accessing or using the Services, you acknowledge that you have read and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Purpose and Permitted Use
The Services are intended to support access to primary care, patient communication, scheduling, telehealth, billing, health education, and other clinic services. You may use the Services only for lawful, personal, and noncommercial purposes.
You agree not to:
2. No Emergency or Guaranteed Medical Response
Do not use the website, portal, email, text messaging, or online forms for a medical emergency. Call 911 or go to the nearest emergency department.
Electronic messages may not be reviewed immediately and do not guarantee a response within a particular time. If you have an urgent but non-emergency concern, call the clinic directly at 682-421-0298. General information on the Services is educational and does not replace an individualized medical evaluation, diagnosis, or treatment. Use of the public website alone does not create a provider-patient relationship. A provider-patient relationship is established only after CaroMas accepts you as a patient and provides or agrees to provide clinical services.
3. Patient Portal and Account Security
Some Services may require a username, password, verification code, or other identifier. You are responsible for:
You may access another person's information only when legally authorized. CaroMas may suspend or restrict access when reasonably necessary to protect patients, information, or system security.
4. Telehealth Services
Telehealth availability depends on clinical appropriateness, provider licensure, patient location, technology, payer requirements, and applicable law. Telehealth has limitations, including the possibility that a provider may be unable to perform a complete physical examination or that technology may fail.
A provider may recommend an in-person examination, laboratory testing, imaging, specialist care, or emergency evaluation when clinically appropriate. Separate telehealth consent, identity verification, privacy, and billing requirements may apply.
5. Privacy and Protected Health Information
CaroMas handles protected health information in accordance with the Health Insurance Portability and Accountability Act (HIPAA), the Texas Medical Records Privacy Act, and other applicable laws.
Our Privacy Policy explains how information collected through the Services is handled. Our Notice of Privacy Practices explains how medical information may be used or disclosed and describes your HIPAA rights. These documents are incorporated into these Terms by reference.
Do not submit another person's health information unless you are legally authorized to do so. Communications containing protected health information will be handled according to applicable privacy laws and clinic policies.
6. Electronic Communications
When you voluntarily provide your contact information and consent to electronic communications, CaroMas may send SMS messages or email for appointment reminders, scheduling updates, billing notices, notifications that information is available, and other healthcare-related administrative messages.
Message frequency varies. Message and data rates may apply. Text-message consent is not required to receive care. You may reply STOP to discontinue text messages or HELP for assistance.
Standard email and text messages may not be encrypted. Avoid sending highly sensitive information through unsecured channels. Use the secure patient portal when available. You are responsible for keeping your contact information current.
7. Payments and Insurance
Amounts displayed through an online payment or scheduling service may be estimates and may not reflect the final amount owed. Insurance coverage, deductibles, coinsurance, copayments, noncovered services, and claim determinations are controlled by the patient's health plan and applicable agreements.
Patients remain responsible for charges assigned to them under clinic financial policies and applicable law. Online payment services may be operated by third-party vendors subject to their own terms and privacy practices.
8. Intellectual Property
Unless otherwise stated, the text, graphics, logos, designs, forms, and other content created for the Services are owned by or licensed to CaroMas and are protected by applicable intellectual-property laws.
CaroMas grants you a limited, revocable, nonexclusive right to access, download, or print nonconfidential content for personal and lawful use. You may not reproduce, alter, distribute, publish, sell, or commercially use clinic content without prior written permission, except as permitted by law.
9. Third-Party Services and Links
The Services may contain links to third-party portals, laboratories, pharmacies, payment processors, telehealth platforms, educational resources, or other websites. Third parties control their own services, content, security, availability, and privacy practices.
A link does not constitute an endorsement or guarantee. Review the terms and privacy policy of a third-party service before using it or submitting information.
10. Cookies and Online Technologies
CaroMas may use cookies and similar technologies necessary to operate, secure, and improve the Services. Browser settings may allow you to block certain cookies, but doing so may prevent some features from working properly.
CaroMas does not authorize tracking technologies to collect or disclose protected health information unless the activity is permitted by law and appropriate HIPAA safeguards are in place. Additional information is available in our Privacy Policy.
11. Availability, Accuracy, and Disclaimers
We make reasonable efforts to keep the Services available, accurate, and secure, but we do not guarantee uninterrupted access, error-free operation, or that all information will always be complete or current. The Services may be unavailable because of maintenance, technical failure, security concerns, emergencies, or circumstances beyond our control.
To the fullest extent permitted by law, the Services and general website content are provided "as is" and "as available." Nothing in these Terms excludes or limits a right or responsibility that cannot lawfully be excluded, including responsibilities arising from professional healthcare services.
12. Limitation of Liability
To the fullest extent permitted by law, CaroMas will not be responsible for indirect, incidental, special, or consequential damages resulting solely from use of, inability to use, or reliance on the public-facing Services. This limitation does not apply where prohibited by law and does not waive any patient right or professional duty applicable to healthcare provided by CaroMas.
13. Suspension or Termination
CaroMas may suspend, limit, or terminate access to all or part of the Services when reasonably necessary for security, maintenance, legal compliance, misuse prevention, or protection of patients and others. Provisions that by their nature should continue after termination will remain effective.
14. Changes to These Terms
CaroMas may update these Terms to reflect changes in its Services, operations, technology, or legal obligations. Updated Terms will be posted with a revised effective date. Continued use of the Services after an update constitutes acceptance of the revised Terms to the extent permitted by law.
15. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Unless applicable law requires otherwise, any legal action concerning these Terms or the Services must be brought in a state or federal court with proper jurisdiction in Tarrant County, Texas.
16. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain effective. These Terms, together with the Privacy Policy, Notice of Privacy Practices, and any service-specific consent or agreement, constitute the applicable agreement concerning use of the Services. Clinical, financial, telehealth, and patient-consent documents remain separately enforceable according to their terms.
